Industries have been categorized based on their pollution capacity and hazard in Indian states. The purpose of such categorization is to protect ecologically sensitive areas or areas of specific importance. This has for the first time brought the concept of categorization of industries to” Red”, “Orange “and “Green” and restrict their operation in certain areas of importance. These categories are important as the time limit of NOC and fees which has to be paid at the time of registration vary based on the categorization.

When an industry is categorized as a White category, it does not have to apply for a CTE or CTO in the pollution control board. These industries are considered to not be polluting and just a simple intimation from the business to the State Pollution Board would amount to their NOC.

Consent to Establish: – Consent to Establish (CTE) needs to be obtained by a plant or manufacturing concern before establishing the business. This permit allows the businesses to start construction of a manufacturing plant and get permission to establish it in a certain place. Adequate information regarding scale and type of production needs to be filed and consent for the same needs to be taken from the state government. This also helps the government to keep a record of all the industrial pollution in the country

Consent to operate: – Consent to Operate is the full form of CTO in pollution control boards given by the government and is necessary as a separate NOC. It ensures the industry is in compliance with pollution norms and needs to be renewed after a certain period of one year.

Renewal of Consent to Operate: This type of consent is availed by industries that already have consent to operate and need to renew their NOC. Renewal is based on the categorization of Red, Orange, and Green Industries. While CTE can be said to be a single-time construction permit that is not required for an already established business. CTO in the pollution control board is supposed to be maintained and renewed as it is not perpetual.

Procedure for Hazardous Waste Authorization

  • Fill the requisite form that form I, II or III as per the kind of business
  • Attach all the required attachment with forms
  • Documents should be signed by an authorized person
  • Submit the form to the concern SPCB or pollution board
  • Do the liasoning with concern department
  • IF the form is proper and fine the department will grant the certificate

For bedded Health Care Facilities (HCFs)

  • Application in Form-ll of Biomedical Waste Management Rules, 2016
  • Authorization fees for five years for the Red Category (Total wastewater Generation of more than 100 KLD or with incinerator) and ten years for the Orange-category (Total wastewater generation of up to 100 KLD and without Incinerator) through online payment as per the Board’s fee structure.
  • Copy of consent to operate order issued by SPCB, Odisha.
  • Agreement copy with the Common Biomedical Waste Treatment Facility (in case of units joined with CBWTF).

For non-bedded Health Care Facilities (HCFs)

  • Application in Form-ll of Biomedical Waste Management Rules, 2016.
  • Authorization fees one time through online payment as per Board’s fee structure.
  • Agreement copy with the Common Biomedical Waste Treatment Facility (in case of units joined with CBWTF).

For Common Biomedical Waste Treatment Facility (CBWTF)

  • Application in Form-ll of Biomedical Waste Management Rules, 2016.
  • Authorization fee for five years through online payment as per Board’s fee structure.
  • Copy of consent to operate order issued by SPCB, Odisha.
  • Map with GPS locations of CBWTF and area of coverage. 
  • Contingency plan of CBWTF.

Frequently Asked Questions

The major Difference between Consent to Establish (CTE) and Consent to Operate (CTO) is that CTE needs to be taken before initiating construction of the plant and after a site inspection of completion of construction of the plant one can apply for CTO.

An NOC is valid for a period of six months. Once the NOC is expired, you will not be able to produce the same for re-registering.
